Terms Of Service:  Client is to pay the Contractor the full amount specified in any invoice within 30 calendar days of the invoices date, if the payment is not received within 60 days the we will discontinue services.

NOTICE OF PRE-LIEN: This notice is to advise you of your rights under the Kansas and Missouri Law in connection with the improvement of your property. If the company has not received the payment within 60 days of the projects completion we have the right to discontinue our services. A 10% Late Fee will be added to Invoices over 120 days. Any person or company supplying labor or materials for the improvement may file a lien against your property if the person or company has not been paid for the contributions. Under Kansas and Missouri law, you have the right to pay persons who supplied materials and labor for this improvement directly and deduct the amount from the contract prior of withheld the amounts due to them from 120 days of completion of the improvement unless we give you a lien waiver signed by persons who supplied any labor or materials for the improvement and who gave you a timely notice. 

LIMITATION OF LIABILITY & ACCEPTANCE OF CONTACT: To the fullest extent permitted by law, and notwithstanding any other provisions of this Agreement, the total liability, in the aggregate, of Contractor officers, employees, agents and Contractor’s sub-consultants, and any of them to the Client and anyone claiming by, through or under the Client, for any and all claims, or the Agreement from any other cause or causes, including but not limited to the negligence, professional errors or omissions, strict liability or breach of contract, or warranty express or implied of Contractor officers, employees, agents or Contractors sub-cultants, shall, not exceed the total compensation received by Contractor, under this Agreement. The Contractor shall not be responsible for delays or losses caused or attributable, in whole or in part, to circumstances beyond its reasonable control, including but not limited to, acts of God, governmental restrictions or requirements, severe or unusual weather, natural catastrophes, vandalism or acts of third persons. Client assumes the full risk of loss attributable to all such occurrences, including but not limited to, the repair or replacement of landscaping. A 50% down payment of the total balance will be due upon completion day on invoices exceeding $500+.
